Terms of Service

1. Eligibility and accounts

• ·You must be at least 18 years old and able to form a binding contract.
• ·You authenticate through Discord. You are responsible for all activity under your account and for keeping your credentials secure.
• ·You must provide accurate information and may not impersonate others or use the Services on behalf of a sanctioned party.

2. The Services

We resell premium residential proxy bandwidth. Purchases are prepaid bandwidth allocations billed per gigabyte. Bandwidth is delivered as proxy credentials accessible from your dashboard immediately after payment is confirmed.

• ·Bandwidth is consumable and is drawn down as you use it.
• ·Each allocation is valid for the access window stated at purchase (currently six months) and expires afterward whether or not it is fully used.
• ·Proxy performance, availability, and geographic coverage depend on an upstream provider and are not guaranteed.

3. Payment

• ·Payments are processed by Stripe. By purchasing you agree to Stripe's terms in addition to these Terms.
• ·Prices are shown at checkout and are charged as one-time purchases. You are responsible for any applicable taxes.
• ·You authorize us to provision bandwidth on your behalf with our upstream provider upon successful payment.

4. Refunds and chargebacks

Bandwidth is a digital, consumable good delivered instantly. Except where required by law:

• ·All sales are final once credentials have been issued. Bandwidth that has been used is non-refundable.
• ·If you believe an order failed to provision, contact us and we will investigate and, where appropriate, re-provision or credit the affected amount.
• ·Initiating a chargeback or payment dispute without first contacting us is a material breach and may result in immediate suspension or termination of your account and forfeiture of remaining bandwidth.

5. Acceptable use

Your use of the Services is subject to our Acceptable Use Policy, which is incorporated into these Terms. Violation may result in immediate suspension or termination without refund and, where warranted, referral to law enforcement.

6. Suspension and termination

• ·We may suspend or terminate your access at any time for violation of these Terms or the Acceptable Use Policy, for suspected fraud, or to comply with law.
• ·You may stop using the Services at any time. Expired or forfeited bandwidth is not refundable.
• ·Sections that by their nature should survive termination (including payment obligations, disclaimers, limitation of liability, and indemnification) will survive.

7. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any particular IP, location, or throughput will be available at any given time.

8. Limitation of liability

To the maximum extent permitted by law, Sacred Proxies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total aggregate liability arising out of or relating to the Services will not exceed the amount you paid us in the three months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Sacred Proxies and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms or the Acceptable Use Policy, or your violation of any law or third-party right.

10. Changes

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Continued use of the Services after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to arbitration or small-claims resolution.
